1. About GutTrace

GutTrace is a personal food diary and health-pattern tracking application operated by OdO Holding B.V., registered in the Netherlands (Chamber of Commerce / KVK: 77612752).

2. Acceptance of These Terms

By creating an account or using the GutTrace app, you agree to these Terms and Conditions in full. If you do not agree, you must stop using the app.

You must be at least 16 years old to use GutTrace. If you are under 16, you may only use the app with the explicit consent of a parent or guardian.

3. Changes to These Terms

GutTrace may amend these Terms and Conditions at any time. We will notify you of material changes at least 30 days in advance by email and/or by a prominent notice in the app. Non-material changes (such as corrections of typographical errors or clarifications that do not affect your rights) may be made without advance notice.

After notification of a material change, you have the right to terminate your account free of charge before the change takes effect. If you continue to use GutTrace after the change has taken effect, you are deemed to have accepted the updated terms.

The most recent version of these Terms is always available in the app and at https://guttrace.com/terms.

4. Account Management

You can create an account using your email address and a password. We may add additional sign-in options (such as Sign in with Apple or Sign in with Google) in the future.

You are responsible for keeping your login credentials confidential. Any activity that occurs under your account is your responsibility. If you suspect unauthorised access, notify us immediately at info@guttrace.com.

You may hold only one account. Accounts are personal and may not be transferred or shared with others.

5. Acceptable Use

GutTrace is for personal, non-commercial use only. When using the app, you must not:

  • Attempt to reverse-engineer, decompile, or disassemble the app or its underlying software;
  • Scrape, crawl, or systematically extract data from the app;
  • Circumvent, disable, or abuse any technical limitation, quota, or access control;
  • Upload content that infringes the intellectual property rights of third parties;
  • Upload content that is unlawful, harmful, defamatory, or offensive;
  • Use the app in a way that disrupts its operation or availability for other users;
  • Create accounts in an automated or fraudulent manner.

GutTrace reserves the right to remove content that violates these rules.

6. Sanctions

If you violate these Terms, GutTrace may, depending on the nature and severity of the violation:

  • Issue a warning;
  • Temporarily suspend access to your account;
  • Permanently terminate your account.

In cases of serious or repeated violations, GutTrace may act without prior notice. Termination for cause does not entitle you to a refund of any remaining subscription period.

GutTrace may also take legal action or report violations to relevant authorities where required by law.

7. Intellectual Property

The GutTrace app, including its design, software, branding, and all content created by GutTrace, is the intellectual property of OdO Holding B.V. or its licensors. Nothing in these Terms transfers any ownership of that intellectual property to you.

You retain ownership of the content you create in the app, such as your meal logs and uploaded photos. By submitting content, you grant GutTrace a limited, worldwide, royalty-free licence to store, process, and display that content solely for the purpose of providing the service to you. This licence ends when you delete the content or close your account.

The app may incorporate open-source software components. Their respective licences apply to those components.

8. Ingredient Estimates, Correlation Summaries, and Wellness Disclaimer

GutTrace may use automated tools, including AI, to estimate ingredients and nutritional information from meal entries or photos. These estimates are approximations only and may contain errors or inaccuracies.

Separately, GutTrace may calculate possible statistical correlations between ingredients you log and feelings or digestive observations you record. These correlation summaries are based only on your own diary entries. They do not prove causation and should not be treated as medical conclusions.

GutTrace is a personal food diary and wellness self-tracking tool. It is not a medical device and does not provide medical, nutritional, diagnostic, or treatment advice. Do not use GutTrace to diagnose, prevent, monitor, predict, treat, cure, or alleviate any disease, disorder, injury, or medical condition.

GutTrace does not recommend that you start, stop, restrict, or materially change any diet, medication, supplement, treatment, or medical care. Always consult a qualified healthcare professional before making significant health, diet, medication, or treatment decisions.

9. Third-Party Services

GutTrace relies on third-party services for functions such as hosting, payment processing, and AI-powered analysis. These third parties are contractually required to handle your data in accordance with applicable law and are listed in our Privacy Policy.

GutTrace is not responsible for outages, errors, or failures caused by third-party services.

10. Subscription and Payments

GutTrace offers a free tier with limited functionality and a paid premium subscription. The free tier allows you to log meals up to a set limit per period. The premium subscription removes that limit and unlocks additional features.

Premium subscriptions are sold and managed through the Apple App Store or Google Play Store. Billing, pricing, and payment terms are governed by your agreement with Apple or Google. GutTrace does not process payment data directly.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period through your App Store or Play Store account settings. GutTrace cannot cancel a subscription on your behalf.

Current pricing is displayed in the app before purchase. GutTrace may change subscription prices; changes will be communicated in advance and will not take effect until the next renewal.

Where your subscription is purchased through the Apple App Store or Google Play Store, refund handling may be subject to Apple's or Google's applicable refund process. Cancelling a subscription prevents future renewal but does not automatically refund the current subscription period unless required by law or granted by Apple, Google, or GutTrace.

11. Right of Withdrawal (Herroepingsrecht)

Under Dutch and European consumer law, you have the right to withdraw from a distance purchase within 14 days without giving a reason (Article 6:230o of the Dutch Civil Code / Consumer Rights Directive 2011/83/EU).

However, for digital content that is not supplied on a physical medium, the right of withdrawal lapses once delivery has begun, provided that:

  • You have given your prior explicit consent to the performance beginning before the withdrawal period has expired; and
  • You have acknowledged that you will lose your right of withdrawal as a result.

GutTrace will ask for this consent and acknowledgement explicitly at the moment of purchase. If you grant it, your right of withdrawal lapses immediately upon activation of your subscription.

If you do not give that consent, the standard 14-day withdrawal right applies and you may request a full refund within that period by contacting info@guttrace.com.

12. Privacy and Security

Your privacy is important to us. How we collect, use, and protect your personal data is described in our Privacy Policy, which forms part of these Terms.

We implement appropriate technical and organisational measures to protect your data. However, no system is completely secure. You are responsible for keeping your account credentials safe.

13. Availability and Changes to the Service

GutTrace aims to keep the app available at all times but does not guarantee uninterrupted access. We may take the app offline temporarily for maintenance, updates, or circumstances beyond our control.

GutTrace reserves the right to modify, limit, or discontinue features or the service as a whole. If we discontinue the service entirely, we will give you reasonable advance notice and the opportunity to export your data.

You can delete your data at any time through the app's settings or by contacting us.

14. Liability

To the fullest extent permitted by Dutch law, GutTrace is not liable for:

  • Indirect or consequential damages, including loss of data or loss of profit;
  • Inaccuracies in ingredient estimates or correlation summaries;
  • Decisions you make based on information shown in the app;
  • Failures or outages of third-party services.

Where liability cannot be excluded under mandatory Dutch consumer protection law, our total liability is limited to the amount you paid for the subscription in the three months preceding the event giving rise to the claim.

Nothing in these Terms limits your mandatory rights under Dutch or EU consumer law, including statutory rights relating to digital services, conformity, remedies, refunds, or liability that cannot lawfully be excluded.

Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded.

15. Dispute Resolution

If you have a complaint or dispute, please contact us first at info@guttrace.com. We will make every effort to resolve it amicably within 30 days.

If we cannot reach a resolution, disputes will be submitted to the competent court in the Netherlands (district of Amsterdam).

GutTrace is not obliged and does not commit to participate in an alternative dispute resolution procedure, unless required by applicable law.

These Terms are governed by the laws of the Netherlands. Mandatory provisions of the law of your country of residence as an EU consumer always apply.

16. Digital Services and Updates

We will provide the digital service with reasonable care and skill and will provide updates, including security updates, where required by applicable consumer law.

Nothing in these Terms affects your statutory rights if the service does not conform to the contract.
